Duvall to be sentenced on drug-related charges in North DakotaA Williston, North Dakota woman facing multiple drug-related charges is scheduled for sentencing in two of the counts Wednesday, but her attorney is appealing the decision to the North Dakota Supreme Court.
Desire Duvall, 32, will be sentenced this week for her Oct. 24 conviction of Class C felony possession of meth paraphernalia and Class A misdemeanor of possession of marijuana paraphernalia.
On Dec. 3, the State requested that Duvall's bond be modified to allow for testing of controlled substances. Northwest District Judge David W. Nelson made the order she be tested within 48 hours. Testing showed positive for methamphetamine and marijuana.
She is currently released on $5,000 cash only bond on the July 2002 charges. On those charges, she is being represented by Kevin Chapman. Chapman has filed an appeal on her behalf.
In separate charges, a Feb. 4 pretrial conference has been set for Duvall for Class C felony possession of methamphetamine paraphernalia, Class C felony possession of methamphetamine, Class A misdemeanor of possession of marijuana paraphernalia and Class A misdemeanor of marijuana.
The latter charges stem from a July 9th incident where materials connected with meth and marijuana were found at the Ivy Arnold residence at 2600 University Ave. No. 83.
For the July 9th charges, Duvall is being represented by Jeff Nehring. Chapman requested another attorney represent Duvall on the latest charges due to conflict of interest on those counts.
Each Class C Felony could carry a maximum sentence of five years in prison and a $5,000 fine. Each Class A misdemeanor carries a maximum sentence of one year in prison and $2,000 fine.
